Employers beware. If employers want to mitigate their legal exposure and ensure they are safeguarding employee rights, they must properly investigate workplace employment based complaints. Some employers choose to conduct their own internal investigations to save money, time or simply because the employer feels they know their employees best. There are many reasons why this approach is not always the most prudent. The National Labor Relations Board recently made a ruling in Banner Health System d/b/a Banner Estrella Medical Center and James A. Navarro. Case 28–CA–023438 reminding employers they must be careful in their approach to conducting the investigations. The full ruling may be found by clicking here. Hiring an independent third party who is more focused on proper workplace investigations may be wise.
